Bookings under discussion for which the Musician and Host have not received a Booking Confirmation can be cancelled at any time. Bookings that involve compensation that does not involve payment through Gigwax’s third-party payment processor, such as non-monetary consideration or cash consideration that the parties have agreed will be delivered in person, are not subject to this Cancellation Policy and any cancellations related thereto must be resolved solely between the Musician and Host.
If the Host cancels the booking after receipt of a Booking Confirmation, the Musician is entitled to a cancellation fee equal to:
If the Host cancels the booking more than one (1) week prior to the applicable event, the Musician is not entitled to any compensation.
If the Musician cancels the booking after receipt of a Booking Confirmation or is otherwise unable to provide services for the applicable event due to no fault of the Host (e.g., if the Musician’s equipment fails), the Host is entitled to a refund equal to the full amount set forth in the Booking Confirmation (excluding any additional processing or administrative fees identified therein). In addition, if the Musician cancels the booking prior to the applicable event, Gigwax will use reasonable efforts to assist the Host in attempting to find a suitable replacement for services for the applicable event, subject to the Host’s final approval of such replacement. Notwithstanding the foregoing, Gigwax does not guarantee that it will be able to find the Host a replacement under such circumstances and will not be liable for any damages related to the Musician’s cancellation and/or the inability of the Host to find a suitable replacement. If the cancellation occurs less than 48 hours prior to the event, the Musician who cancelled will incur a negative statement on his or her profile. After three (3) negative statements on a Musician’s profile, such Musician’s profile will be removed from the Site.
YOU UNDERSTAND AND AGREE THAT COMMUNICATIONS AND DISPUTES REGARDING CANCELLED BOOKINGS AND RELATED REFUNDS OR CANCELLATION FEES ARE SOLELY BETWEEN MUSICIANS AND HOSTS. YOU UNDERSTAND THAT GIGWAX WILL NOT REFUND ANY AMOUNTS TO YOU FOR CANCELLED BOOKINGS EXCEPT AS DESCRIBED ABOVE.
We reserve the right, in our sole discretion, to change or modify portions of this Cancellation Policy at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date this Cancellation Policy was last revised. You may read a current, effective copy of this Cancellation Policy at any time by selecting the “Cancellation” link on the Site. We will also notify you of any material changes either through a pop-up notice, e-mail or through other reasonable means. Your continued use of the Site after any such changes constitutes your acceptance of the new Cancellation Policy. You should periodically visit this page to review the current Cancellation Policy so you are aware of any revision to which you are bound. If you do not agree to abide by this or any future Cancellation Policy, do not use or access (or continue to use or access), browse or use the Site.
